Terms of Service

1. Acceptance of Terms

Overhear is provided by Hauke Jung ("we," "us," or "our"). By using the Service at https://overhear.dev, or its API and MCP endpoint, you agree to these Terms of Service ("Terms") and the policies referenced here. If you do not agree, do not use the Service.

2. Description of Service

Overhear searches public platforms (X, Reddit, LinkedIn, YouTube and the web) for posts containing keywords you choose, classifies them automatically, and shows them in a feed with optional email alerts, webhooks and an MCP endpoint that AI assistants can connect to. If you use the Service as a consumer, statutory consumer protection rights under applicable EU or German law apply.

3. User Accounts

You must be at least 16 years old to create an account.
Provide accurate information and keep it current.
You are responsible for safeguarding your sign-in credentials and for all activity under your account and your organization.
Notify us at mail@haukejung.de if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms or pose security risks.

4. API Keys and Access

API keys grant access to your organization's projects and mentions. Keep them confidential and revoke them in Settings when no longer needed.
You are responsible for all activity performed with keys issued to your account, including by assistants and automations you connect.

5. Acceptable Use

You agree to:

Comply with applicable law, including the GDPR, when you use the mentions you receive.
Track keywords only for legitimate purposes such as monitoring your own product, brand or market — not to surveil, profile or harass individuals.
Not contact the authors of mentions in ways that violate a platform's rules or anti-spam law.
Not interfere with or disrupt the Service, its infrastructure or other users' access, and not conduct security tests without prior written consent.
Respect rate limits.

6. Intellectual Property

The Service, its code, design and documentation remain the intellectual property of Hauke Jung or its licensors.
Subject to these Terms, we grant you a non-exclusive, non-transferable license to use the Service while your account exists.
You retain all rights to the settings and content you add. Posts found on public platforms belong to their authors; the Service shows them to you so you can read and respond to them, under the rules of the platform they come from.

7. Your Data and Other People's Data

We process personal data as described in our Privacy Policy.
Mentions contain personal data of their authors. You may use them to understand and respond to what is said about your product. Using them for other purposes, such as building profiles of individuals, is your responsibility and requires your own lawful basis.

8. Automated Classification and Search

Search results depend on the platforms and data providers queried; we cannot guarantee that every public mention is found, or found promptly.
Classification is automated and can be wrong: a complaint may be marked as praise, an urgent post missed, or a post about something else matched to your keyword. Review what the Service shows before relying on it, and do not rely on it as your only channel for time-critical issues.
When you set a webhook or connect an assistant, the Service sends it what you ask for. We are not responsible for how that system processes or stores the data.

9. Availability and Limits

We may set limits on keywords, scans or requests and change them with reasonable notice.
We do not guarantee any specific availability level unless separately agreed in writing.

10. Payment Terms

The Service is currently offered without charge. No payment details are collected.
If paid plans are introduced, we will give reasonable advance notice, and no charge will be applied to an existing account without your explicit agreement.
If you are a consumer in the EU, your statutory right of withdrawal under §355 BGB remains unaffected should paid plans be introduced.

11. Disclaimers

The Service is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation.
Except as required by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Hauke Jung is not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, including damages from a mention that was missed, misclassified or delivered late.
Where the Service is provided without charge, our aggregate liability is limited to the maximum extent permitted by law.
Nothing in these Terms limits liability for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body or health, or under mandatory consumer protection law.

13. Termination

You may delete a project at any time in Settings → Delete project, and your account by contacting mail@haukejung.de.
We may suspend or terminate your access if you violate these Terms or create security or legal risks.
On termination your license ends and your data is deleted as described in the Privacy Policy.

14. Governing Law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence.
Disputes should first be resolved amicably.

15. Changes to Terms

We may update these Terms to reflect changes in law, features or our practices. Material changes will be announced by email or a notice on the website at least fourteen (14) days before they take effect, unless an immediate change is required by law. Continued use after the effective date constitutes acceptance.

16. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hauke Jung regarding Overhear.
